Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Upcharify Health Tech Pvt Ltd ("Company", "we", "us", or "our"), governing your access to and use of the Upcharify mobile application and related services (the "Platform").

By downloading, installing, registering, or using the Platform, you confirm that you are at least 18 years of age (or using the Platform under parental supervision), have read and understood these Terms, and agree to be bound by them.

Nature of Services

Upcharify is a technology platform that facilitates:

• Online consultations between patients and registered healthcare professionals.
• Appointment scheduling and management.
• Digital prescription viewing and medical record storage.
• Health information and wellness content.

User Accounts

3.1 Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You agree to:

• Keep your password confidential and not share it with others.
• Immediately notify us at support@upcharify.com of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

3.3 One Account Per User

Each individual may maintain only one patient account. Creating multiple accounts to circumvent restrictions or policies is prohibited.

Healthcare Professionals

Doctors and healthcare providers on the Platform:

• Are independently registered professionals holding valid licenses under applicable Indian medical laws.
• Are solely responsible for the medical advice, diagnoses, and treatment plans they provide.
• Have agreed to separate terms with Upcharify governing their conduct on the Platform.

Upcharify does not employ, supervise, or control healthcare professionals in the exercise of their medical judgment.

Prohibited Conduct

You agree not to:

• Provide false, misleading, or fraudulent information on the Platform.
• Use the Platform for any unlawful purpose.
• Harass, abuse, or threaten healthcare professionals or other users.
• Attempt to reverse-engineer, hack, or disrupt the Platform.
• Upload or share harmful, obscene, or defamatory content.
• Use the Platform to sell or promote products or services.
• Impersonate any person or entity.
• Use automated tools (bots, scrapers) to access the Platform.

Fees & Payments

Certain services on the Platform are paid. By making a payment, you agree to:

• Pay all applicable fees as stated at the time of booking.
• Ensure your payment method has sufficient funds.
• Accept that all prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

Intellectual Property

All content on the Platform — including but not limited to the app design, logos, text, graphics, features, and code — is the exclusive property of Upcharify Health Tech Pvt Ltd and is protected under Indian intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works without our written consent.

Limitation of Liability

To the maximum extent permitted by applicable law:

• Upcharify is not liable for any medical outcomes resulting from consultations on the Platform.
• We are not responsible for the accuracy, completeness, or timeliness of any medical advice provided by healthcare professionals.
• Our total liability for any claim arising from use of the Platform shall not exceed the amount paid by you for the specific service in question.
• We are not liable for any indirect, incidental, special, or consequential damages.

Indemnification

You agree to indemnify, defend, and hold harmless Upcharify Health Tech Pvt Ltd, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Platform.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.

Termination

We reserve the right to suspend or terminate your account at any time if:

• You breach any provision of these Terms.
• We suspect fraudulent, abusive, or illegal activity.
• Required by law or regulatory authority.

You may delete your account at any time through the app settings or by writing to support@upcharify.com.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of courts in India.

We encourage resolution of disputes through our support team first. For unresolved disputes, parties may seek mediation before pursuing litigation.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email. Continued use of the Platform after such notice constitutes acceptance of the updated Terms.
